By downloading, installing, or using the Hola mobile application ("App" or "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
The App is operated by CHRONOSEIZE 42 TECH PRIVATE LIMITED ("Company", "we", "us", or "our"), a company registered in India.
02Description of Service
Hola is an AI-powered emotional wellness companion application that provides:
- Conversational AI companions for emotional support
- Mood tracking and emotional insights
- Interactive games and wellness activities
- Crisis support resources and helpline access
03Eligibility
To use Hola, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable laws
By using the App, you represent and warrant that you meet these eligibility requirements.
04Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
05AI Companion Disclosure
You acknowledge and understand that:
- All companions in Hola are artificial intelligence, not real humans
- AI responses are generated by machine learning models
- Companions may occasionally provide inaccurate or inappropriate responses
- We continuously work to improve AI quality and safety
06Acceptable Use
You agree NOT to use the Service to:
- Violate any applicable laws or regulations
- Harass, abuse, or harm others
- Share illegal, harmful, or objectionable content
- Attempt to manipulate or exploit the AI system
- Circumvent security measures or access restrictions
- Use automated systems or bots to access the Service
- Collect data about other users without consent
- Impersonate any person or entity
07Subscription and Payments
7.1 Free and Paid Plans
Hola offers both free and paid subscription plans. Paid plans provide access to additional features and unlimited conversations.
7.2 Billing
- Subscriptions are billed in advance on a weekly or monthly basis
- Prices are displayed in Indian Rupees (INR) and include applicable taxes
- Payment is processed through secure third-party payment providers
7.3 Auto-Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage subscriptions in your app settings or through your app store.
7.4 Refunds
Refunds are handled according to our Refund Policy.
08Intellectual Property
All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by the Company and protected by intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
09User Content
You retain ownership of content you submit to the App (such as messages). By using the Service, you grant us a license to:
- Process your content to provide the Service
- Store your content securely
- Use anonymized, aggregated data to improve our AI
10Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
11Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that:
- The Service will be uninterrupted or error-free
- AI responses will be accurate, complete, or appropriate
- The Service will meet your specific requirements
12Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
Our total liability shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.
13Indemnification
You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.
14Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination:
- Your right to use the Service ceases immediately
- We may delete your account and data
- Provisions that should survive termination will remain in effect
15Changes to Terms
We may modify these Terms at any time. We will notify you of material changes through the App or via email. Continued use of the Service after changes constitutes acceptance of the modified Terms.
16Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
